These terms govern the use of our digital marketing services, including but not limited to SEO, Google Ads, Meta Ads, Website Design & Development, and Social Media Management. We reserve the right to update or modify these Terms of Service at any time, so please review them periodically.
SEO Services - Performance Commitment
At 10X Digital, we believe in delivering measurable results. Our SEO services are designed to improve your website’s visibility and rankings on search engines. Below is our Performance Commitment:
Performance Commitment Guarantee:
We commit to achieving the following keyword ranking milestones within the specified timeframes for mutually agreed-upon keywords:
10% of the keywords will reach Page 1 of the SERP within 4 months.
30% of the keywords will reach Page 1 of the SERP within 8 months.
60% of the keywords will reach Page 1 of the SERP within 12 months.
What Happens if We Don’t Meet the Commitment?
If we do not meet the agreed-upon milestones for any of the keywords within the specified timeframes, the following will apply:
50% discount on the total SEO invoice for the month in which we fail to meet the commitment.
Once the commitment is achieved, the full invoice amount will be resumed.
We will continue to work diligently until the commitments are met, and we will resume normal invoicing after hitting the targets.
Note: This is a performance-based commitment, not a guarantee of specific rankings. While we make every effort to meet these milestones, SEO is subject to numerous variables, including algorithm updates, industry trends, and competitor actions. We will provide monthly reports to track progress and ensure transparency.
Payment Terms
All invoices are due according to the payment schedule agreed upon in the service agreement. For ongoing projects, payments must be made monthly or per the agreed contract terms. Failure to make timely payments may result in suspension of services until payment is received.
Modifications to Services
As a dynamic digital marketing agency, 10X Digital continually adapts and refines its services to stay ahead of industry trends. We reserve the right to update, modify, or discontinue any service or feature at any time. In such cases, clients will be informed promptly, and new terms will apply upon agreement.
Client Responsibilities
To ensure the success of our services, we ask clients to:
Provide access to all necessary accounts, tools, and resources in a timely manner.
Collaborate with the 10X Digital team for feedback, approval, and guidance.
Acknowledge that results may vary based on website history, current content, and other factors outside of our control.
Limitation of Liability
While we strive for excellence and adhere to industry best practices, 10X Digital will not be held responsible for:
Loss of traffic or rankings due to changes in search engine algorithms or external factors.
Issues arising from the client's website, including technical problems, hosting issues, or other factors beyond our control.
Termination of Services
Either party may terminate the agreement with written notice if the terms are not being met or if there is a failure to comply with payment terms. In the case of termination by the client, no refunds will be issued for previous services rendered, and outstanding invoices must be settled.
Confidentiality and Data Protection
We prioritize the confidentiality of client data and adhere to all applicable data protection regulations. We will not disclose any personal or business information to third parties without prior consent unless required by law.
Dispute Resolution
In the event of a dispute, both parties agree to first attempt to resolve the issue through amicable negotiation. If the matter cannot be resolved, it may be referred to mediation or arbitration under applicable laws.
Updates to Terms of Service
10X Digital reserves the right to update or modify these Terms of Service at any time. Any changes will be effective immediately upon posting to our website. Clients will be notified of significant changes through email or other means. Continued use of our services after any such change signifies acceptance of the updated terms.
Transition from Performance Guarantee to Performance Commitment
Effective January 1, 2025, 10X Digital will no longer offer a performance guarantee as part of our SEO services. All existing contracts with a performance guarantee will be honored until their respective expiration dates. However, all new contracts signed from January 1, 2025, onwards will reflect our updated Performance Commitment policy, as detailed below.
Existing Contracts: For clients with ongoing contracts that include the performance guarantee, we will continue to fulfill our obligations under the original terms until the contract expires.
Renewals and New Contracts: Upon the renewal of any existing contracts or for any new agreements starting on or after January 1, 2025, the Performance Guarantee will be replaced with the Performance Commitment. This new policy includes the same ranking milestones and timelines, but in the event of non-fulfillment, a 50% discount will be applied to the SEO invoice as per the updated terms.
We believe this change better aligns with industry standards and provides a fair approach to managing the dynamic nature of SEO. If you have any questions regarding this transition or how it affects your contract, please don't hesitate to reach out to us.

By using our services, you acknowledge that you have read, understood, and agreed to the terms outlined above. This agreement represents the entire understanding between 10X Digital and the client regarding the provided services.
